These Terms govern use of TotalSiteControl. They are provided for clarity and are not legal advice. Operator legal entity details will be updated here when finalized.
1. Agreement
By accessing or using TotalSiteControl websites, free diagnostic tools, monitoring features, or related services (the “Services”), you agree to these Terms and our Privacy Policy and Cookie Policy.
If you do not agree, do not use the Services.
2. Services
TotalSiteControl offers:
Free, on-demand network diagnostic tools (for example SSL, DNS, ping, HTTP headers, and related checkers).
Optional monitoring and alerting features that may require an account or email verification.
We may change, suspend, or discontinue features at any time, including free-tier limits.
3. Accounts and eligibility
You must provide accurate information when creating an account or starting monitoring.
You are responsible for activity under your account and for keeping credentials and access to your email secure.
You must be able to form a binding contract under applicable law. The Services are not intended for children under 16.
4. Acceptable use
You agree not to:
- Use the Services to check, scan, or monitor systems you are not authorized to test.
- Attempt to disrupt, overload, reverse engineer, or bypass security or rate limits.
- Use the Services for unlawful, harmful, or abusive purposes (including spam, fraud, or attacks).
- Misrepresent your identity or affiliation.
- Resell or systematically scrape the Services in a way that harms availability, except via documented APIs/terms we expressly allow.
We may throttle, suspend, or terminate access if we reasonably believe these rules are violated.
5. Targets you submit
When you submit a domain, URL, IP address, or similar target, you represent that you have the right to request that check or monitoring.
You are solely responsible for the targets you configure and for any notices or complaints arising from unauthorized scanning or monitoring.
6. Free tools — no warranty
Free diagnostic tools are provided “as is” and “as available” for informational purposes.
We do not warrant that results are complete, error-free, uninterrupted, or fit for a particular purpose (including compliance, security certification, or legal advice).
Always verify critical findings with your own systems, vendors, and professional advisors.
7. Monitoring and alerts
Monitoring depends on external networks and third-party channels (for example email). Delivery delays or failures can occur.
Free and paid plan limits, retention, and feature availability may change. Where a separate order form or plan page applies, those commercial terms also apply.
8. Intellectual property
The Services, branding, and site content are owned by TotalSiteControl or its licensors.
You may not copy, modify, or distribute our branding or software except as allowed by these Terms or written permission.
9. Limitation of liability
To the maximum extent permitted by law, TotalSiteControl and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business interruption arising from use of the Services.
Our aggregate liability for claims relating to the Services is limited to the greater of (a) the amounts you paid us for the Services in the 12 months before the claim, or (b) EUR 50, if you used only free Services.
Nothing in these Terms excludes liability that cannot be limited under applicable law (including certain consumer rights).
10. Indemnity
You will defend and indemnify TotalSiteControl against claims arising from your misuse of the Services, unauthorized targets, or violation of these Terms or applicable law, to the extent permitted by law.
11. Privacy
Personal data is handled as described in our Privacy Policy and Cookie Policy.
12. Governing law
These Terms are governed by the laws of Germany, excluding conflict-of-law rules, unless mandatory consumer protection laws in your country of residence provide otherwise.
Courts in Germany shall have jurisdiction, subject to mandatory consumer venue rules where applicable.
If our registered legal entity is later established in another jurisdiction, we may update this section accordingly.
13. Changes
We may update these Terms by posting a new version with an updated date. Continued use after changes become effective constitutes acceptance, except where mandatory law requires otherwise.
